Musings on the true Nature of Porn

Legally, Prostitution is illegal. (As well it should be!)
Legally, Porn creation is legal. (Free speech vs Morality)

However, couldn’t Porn be looked at like Double (Or Triple, or…) Prostitution? The definition of Prostitution is “The act of offering one’s playboy-8-august-2013self for hire to engage in sexual relations.” Normally, Two People are paid to have sex and perform intimate acts upon each other, for money. A camera and crew are really incidental, at one level, and the footage is later exploited for Third Party Profit.

Nevada is the only state that has some (heavily regulated) legal prostitution. By my (albeit limited, non-legal-professional) understanding, that should be the only place that shooting porn is legal, as such.

Now, the distribution and consumption of porn is clearly a free speech issue, but I am not so sure that the creation of it is. The only argument that I could see would be through artistic license, and the right to create art, free from government interference, for where is the line?

imagesThe difference is a matter of degrees, I suppose, and of exploitation. We don’t want the Government deciding what films and photography are legal, and what are not. We don’t want Taste to be legislated. Art must be free. Unfortunately, we cannot adequately say if porn falls under the purview of art, because we cannot adequately and universally define art.

And some porn may be artfully done, and artistic in nature, further blurring the lines…
